Welcome to Binadamu Global!

This These Terms of Service ("Terms") govern your access to and use of our website, and our B2B and B2C professional services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully.

1. Our Services

Binadamu Global provides strategic consulting services, including but not limited to B2B talent acquisition ("Precision Talent Solutions™") and B2C career strategy ("The Professional Identity Architect / The Career OS"). Our services leverage a combination of artificial intelligence and expert human insight to deliver high-quality strategic assets and advice.

2. Client Responsibilities

To ensure the effectiveness of our Services, you agree to:

  • Provide accurate, complete, and current information through our intake forms and during our engagement.

  • Cooperate with us in a timely manner as may be reasonably required for the provision of the Services.

  • Be solely responsible for the final application and implementation of any advice, documents, or strategies we provide. Our services constitute strategic guidance, not a guarantee of any specific outcome (e.g., securing a job or hiring a candidate).

3. Acceptable Use & Prohibited Activities

To maintain the integrity and security of our Services and intellectual property, you agree not to, nor to attempt to:

  1. a. Use the Services for any illegal purpose or in violation of any local, state, national, or international law.

  2. ​​Violate or encourage others to violate the rights of third parties, including intellectual property rights.

  3. Interfere with the security-related features of the Services, including, without limitation, by:

    1. (i) disabling or circumventing features that prevent or limit use or copying of any content; or

    2. (ii) reverse-engineering or otherwise attempting to discover the source code of the Services, except to the extent that such activity is expressly permitted by applicable law.

  4. Interfere with the operation of the Services or any user's enjoyment of the Services, including, without limitation, by:

    1. (i) uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code;

    2. (ii) making unsolicited offers or advertisements to other users; or

    3. (iii) attempting to collect personal information about users or third parties without their consent.

  5. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

  6. Use our intellectual property, including our methodologies, frameworks, or the "Binadamu Global" name and branding, for any commercial purpose without our express prior written consent.​

4. Fees and Payment

You agree to pay all fees for Services you purchase, in accordance with the pricing and payment terms presented to you for those Services. All fees are non-refundable, except as required by law or as specified in a separate Client Engagement Agreement. We use a third-party payment processor to handle all financial transactions securely.

5. Intellectual Property

Our Intellectual Property: We retain all rights, title, and interest in and to our Services, including our methodologies, frameworks (e.g., "AI Empathy Engine"), proprietary software, and all materials provided to you, other than the final client-specific deliverables. You may not reproduce, modify, or create derivative works from our materials without our express written consent.

Your Deliverables: Upon full payment for the Services, we grant you a worldwide, perpetual, non-exclusive, non-transferable license to use the final, client-specific documents and assets we create for you (e.g., your CV, career blueprint, talent profiles) for your personal or internal business purposes.

6. Confidentiality

We will treat all information you provide to us as confidential and will not disclose it to any third party, except as necessary to provide the Services, as detailed in our Privacy Policy, or as required by law. Similarly, you agree to keep confidential any proprietary information we share with you about our business or methodologies.

7. Privacy and Data Protection

Your privacy is paramount. Our collection and use of your personal information in connection with the Services is described in our Privacy Policy, which is incorporated by reference into these Terms. By using our Services, you agree to the terms of the Privacy Policy.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BINADAMU GLOBAL DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR GUARANTEE ANY PARTICULAR RESULTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BINADAMU GLOBAL, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; OR (B) ANY CONTENT OBTAINED FROM THE SERVICES.

IN NO EVENT SHALL BINADAMU GLOBAL'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO BINADAMU GLOBAL IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of Argentina, without regard to its conflict of law principles. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Buenos Aires, Argentina.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the "Last Updated" date at the top of these Terms. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
